Terms of Service

These Terms of Service (the “Terms”) are a contract between you and ClipKaboom (“ClipKaboom”, “we”, “us”). They govern your access to and use of the ClipKaboom website, apps, and services (together, the “Service”). By creating an account, downloading a clip, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

ClipKaboom is a searchable library of short reaction and meme video clips. Clips are intentionally brief — typically no longer than about eight (8) seconds — and are intended for use as reactions, commentary, and similar short-form expression. We may add, change, or remove clips and features at any time.

2. Accounts

You are responsible for your account and for keeping your credentials secure. You must be old enough to form a binding contract in your jurisdiction. You are responsible for all activity under your account.

3. Plans, billing, and cancellation

ClipKaboom offers a Free plan and paid plans (Pro, Creator, and Team). Paid plans are billed in advance through our payment processor on a monthly or annual basis, as you select at checkout. Paid plans renew automatically until cancelled.

• Cancellation. You may cancel at any time; access continues through the end of the billing period you have already paid for.
• Changes. Upgrades and downgrades take effect as described at checkout and may be prorated.
• Taxes. Stated prices may exclude applicable taxes, which you are responsible for.

4. What paid plans buy

Paid plans sell convenience, not rights. Upgrading unlocks higher-resolution and watermark-free downloads, faster exports, higher or unlimited download limits, and (on eligible plans) API access and bulk tools. Upgrading does not grant you any additional ownership of, or third-party rights in, the underlying footage. See Section 6.

5. Your content and the upload license

If you upload, submit, or otherwise make content available through the Service (“Your Content”), you keep whatever ownership you already have in it. To operate the Service, you grant ClipKaboom a worldwide, non-exclusive, royalty-free, sublicensable, transferable, and perpetual license to host, store, reproduce, transcode, reformat, excerpt, distribute, publicly display, publicly perform, and otherwise use Your Content in connection with operating, promoting, and improving the Service, including making short clips available to other users for download.

You represent and warrant that you have all rights necessary to grant this license and that Your Content does not infringe the rights of, or violate any law applicable to, any third party.

6. Your responsibility for how you use clips

Clips may incorporate third-party material. You, not ClipKaboom, are responsible for determining whether and how you may use a clip, including obtaining any clearances, releases, or licenses required for your particular use (for example, commercial, advertising, or endorsement uses). You assume all liability arising from your use of clips, and you agree that paid features do not constitute a representation by ClipKaboom that any clip is cleared for your intended use.

7. Acceptable use

• Do not break the law or infringe anyone’s rights.
• Do not upload content you do not have the rights to, or that is unlawful, hateful, harassing, or sexually exploitative.
• Do not scrape, resell, or redistribute the library wholesale, or attempt to bypass download limits, watermarks, or access controls.
• Do not misuse the API or interfere with the Service’s operation or security.

8. Intellectual property and DMCA

We respect intellectual property rights and expect you to do the same. If you believe content on the Service infringes your copyright, follow the process on our DMCA & copyright page. We maintain and enforce a repeat-infringer policy as described there.

9. Disclaimers

The Service and all clips are provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty that any clip is suitable or cleared for a given use.

10. Limitation of liability

To the maximum extent permitted by law, ClipKaboom will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the twelve (12) months before the claim or USD $100.

11. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms, including our repeat-infringer policy, or if we reasonably believe your use creates risk or legal exposure for ClipKaboom or others.

12. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will take reasonable steps to notify you. Your continued use of the Service after changes take effect means you accept the updated Terms.
